Who we are

Kithmark is made by Supranucleus, a company registered in Delaware, United States, at [REGISTERED ADDRESS]. "We" and "us" in these terms mean Supranucleus. Kithmark is our trademark.

What these terms cover

These terms cover the Kithmark app, this website, and everything in them: the text, the questions and answers, the research content, the formulas and the way they are combined, the design, and the software. We call all of that "Kithmark content."

Who may use Kithmark

You must be 18 or older. The app asks you to confirm this when you first open it.

What you may do

You may use the app to keep your own family record, for your own use. What you write in the app is yours. We claim nothing in it.

What Kithmark is not

Kithmark is a private record and a set of research readings. It is not therapy, counseling, medical care or legal advice, and it never tells you what a relative is or what to do. Noto and Loma are software running on your phone, not people. They can be wrong.

If you or someone else is in danger, contact your local emergency services.

Your record and your key

Your record is kept on your phone, locked with your passcode. If you turn on backup, it is locked on the phone before it leaves, with a key only you hold. We can't open it. If you lose both your passcode and your backup key, nobody can recover your record, us included.

What you may not do

You may not copy, extract, scrape, collect, republish, sell or license Kithmark content, in whole or in part, by hand or by any automated means. You may not reverse engineer, decompile, decrypt or take apart the app or its content files, except where the law allows it and cannot be limited by agreement. You may not use Kithmark content, or anything derived from it, to build, train, test or improve any other product, service, dataset or machine learning model. You may not remove or change any copyright notice, fingerprint or identifying mark in the app or its content.

Ownership

Kithmark content is protected by copyright and other laws. It is owned by Supranucleus or used under license. Every copy of the content carries marks that identify the build it came from.

Kithmark's formulas, engines, scoring rules and methods, and the questions written for them, are Supranucleus's own work and its trade secrets. They draw on published research, which remains the work of its authors. Supranucleus claims nothing in that research, only in what it built on it.

Practitioners

Practitioners in the directory are independent. We check each one before listing them, but a listing is not an endorsement, and we take no part in their sessions or their fees. A listed practitioner agrees to the practitioner agreement as well.

Our responsibility

We work to keep Kithmark accurate, available and safe, but we provide it as it is. We don't promise it will always be available, free of errors, or right about any person or situation, and nothing in it is professional advice.

As far as the law allows, we are not liable for indirect or consequential loss, or for decisions you make using Kithmark. Our total liability to you for any claim about Kithmark is limited to the greater of what you paid us for Kithmark in the 12 months before the claim and 100 US dollars. Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud, or takes away rights you have under the consumer protection law of the country you live in.

Ending use

You can stop using Kithmark at any time. Deleting the app deletes your record on the phone, and deleting your account in the app deletes your backup and account from our server. We may end access for anyone who breaks these terms.

Law

These terms are governed by the laws of the State of Delaware, United States. If you live in India or another country whose consumer protection law gives you rights that can't be waived, you keep those rights, and you can bring a claim in the courts where you live. Before any claim, write to us at the contact on the Support page, and we'll try to settle it within 30 days.

If these terms change, the app and this page will say so. Questions go to the contact on the Support page.
